REGULAMENTO DO LEILÃO
V. COMISSÕES
V.I. A comissão fixa do leiloeiro do pregão se dará, independentemente do valor do arremate, isto é, de forma fixa, em 5% (cinco por cento) do valor do lance final, devendo ser pago no ato da compra.
V.II. As comissões destinadas à Bolsa de Arte, ora organizadora do evento, também deverão ser pagas aomomento do arremate, dando-se a fração na seguinte proporção:

I. LEILÃO
I.I. A Bolsa de Arte, ora organizadora do pregão, com o mais devido primor técnico na apuração e seleçãodas obras de arte componentes destinadas a leilão, formularam o catálogo de maneira proba edetalhada, consoante aos parâmetros mais exigentes no mercado.
I.II. As obras disponibilizadas em leilão são propriedade de terceiros, onde as vendas realizar-se-ãoconsoante às características da obra de arte ao momento do pregão, onde já se presume que oarrematante anuiu com o estado do bem.
I.III. Todo o esmero e cautela empreendidos na análise das obras de arte do leilão pela Bolsa de Arte nãoexime, e tampouco impede, que o possível arrematante proceda à minuciosa análise e exame dasobras de arte destinadas ao pregão in situ, durante as exposições que irão se realizar antes do pregão.
I.IV. Para que seja possível a participação em leilão, será exigido o completo preenchimento dos dados solicitados de maneira verídica e compromissada perante à lei, restando como tacitamente entendidaa compreensão e a aceitação deste documento em sua totalidade.
II. RESPONSABILIDADE PELA AUTENTICIDADE DAS OBRAS
II.I. A Bolsa de Arte se responsabiliza pela autenticidade das obras disponibilizadas, baseadas em laudofirmados por peritos aptos e idôneos para tanto.
II.II. É assegurado ao arrematante a devolução do produto, podendo este requerê-la na hipótese decomprovada inautenticidade, no prazo de 30 (trinta) dias contados do arremate.
II.III. A requisição de devolução do valor do arremate descrita no tópico acima deverá estar devidamente amparada por laudo técnico, fornecido e pago pelo comprador, em até 60 (sessenta) dias, de modo aanular a transação.
II.IV. O laudo, suficiente a constatar possível inautenticidade do objeto do leilão, deverá, obrigatoriamente,obedecer à forma escrita, bem como estar assinado por perito reconhecido no mercado ou por firmacuja autenticidade de atuação no ramo seja inequívoca.
II.V. O arrematante de obra inequivocamente inautêntica, comprovada por laudo, terá direito à devoluçãointegral do lance em até 15 (quinze) dias úteis contados do desfazimento do negócio, tendo como contraprestação o dever de devolver a obra em questão no mesmo estado em que se encontrava aomomento da venda.
II.VI. Esgotado o prazo de 60 (sessenta) dias mencionado em epígrafe (II.III), não será mais possível aoarrematante realizar supervenientes reclamações em relação à venda.
II.VII. Tentativas de devolução no que tangem a alegações de má-conservação das obras de arte não serão aceitas de imediato, já que existe a possibilidade de o possível arrematante proceder à vistoria das obras durante as exposições que acontecem antes do pregão, conforme o teor da cláusula expressaacima.
III. RESPONSABILIDADE PELA VEICULAÇÃO DE IMAGENS
III.I. Quaisquer e eventuais imagens das peças disponibilizadas pelas mídias sociais da Bolsa de Arte, bem como em seu site eletrônico (https://bolsadearte.com), possuem apenas o escopo de promover às belas artes e convidar interessados ao pregão, sendo, para tanto, meramente ilustrativas, não seprovando elemento suficiente à preencher qualquer parâmetro de exigência técnica, no sentido de seaveriguar o estado do objeto ou influenciar no andamento dos lances durante o leilão.
IV. LANCES
IV.I As obras destinadas ao pregão possuem o seu preço mínimo devidamente acertado entreconsignante e consignatário, onde se reserva ao leiloeiro o direito de defender o valor mínimoacordado.
IV.II. Os lances oferecidos possuem como característica serem irretratáveis e irrevogáveis em suaintegralidade, sendo, portanto, vedado o exercício do arrependimento, vez que estes – lances – não poderão ser anulados em nenhuma hipótese.
IV.III. Ordens de compra estipuladas conforme o limite máximo indicado pelos interessados pode ser aceitopelo leiloeiro, hipótese em que um funcionário credenciado irá ficar responsável por licitar até o limiteautorizado.
IV.IV. Dos arrematantes exigir-se-á, após adjudicação, assinatura de termo de compromisso.
IV.V. Apenas após a declaração de arrematação proferida pelo leiloeiro, onde indicar-se-á o lote, o valor e oarrematante, é que irá formar-se o ato jurídico perfeito e acabado.
IV.VI. Eventuais alegações de perda de oportunidade por instabilidade nas linhas telefônicas, bem como na plataforma online do leilão durante o pregão, que aleguem que determinado lance não foicomputado, não poderão ser alegadas, uma vez que a Bolsa de Arte não se responsabiliza pelamanutenção destes meios.
IV.VII. Cabe ao leiloeiro do pregão decidir o valor do incremento à cada lance, conforme sua vontade,experiência e andamento do leilão.
V. COMISSÕES

VI. PAGAMENTO
VI.I. Ao momento da compra, o arrematante deverá cumprir com o pagamento do valor total do(s) lote(s)em até 15 (dias) corridos.
Vi.II. As comissões, devidamente descritas em tópico anterior (V.II), são cumulativas.
VI.III. O não-pagamento das obras arrematadas ensejarão o desfazimento da venda, podendo o leiloeiro e a Bolsa de Arte acionar judicialmente o arrematante para exigir a cobrança do valor ainda em aberto, onde também poderá exigir multa equivalente a 30% (trinta por cento) do preço da arrematação.
VI.IV. Ainda assiste ao leiloeiro, à Bolsa de Arte e ao consignante a possibilidade de se executar judicialmenteo arrematante, pelo total da arrematação e das comissões.
VI.V. O conteúdo do dispositivo acima independe da averiguação de perdas e danos, onde incide sob talquestão correção monetária, juros legais, bem como cabe ao leiloeiro exigir as despesas na execução dopregão.
VI.VI. Ambos, consignante e consignatário, poderão ainda sacar título creditício para pagamento à vista em face do arrematante, bem como tomar outras medidas executórias e cabíveis em prejuízo doarrematante inadimplente.
VI.VII. Os pagamentos efetuados por cheque serão submetidos à consulta e confirmação bancária, podendoo leiloeiro reter o lote comprado até o recebimento do valor total.
VII. RETIRADA
VII.I. Deverão as obras arrematadas serem retiradas em até 10 (dez) dias úteis após o recebimento do valor total pelo leiloeiro, onde após decorrido este prazo se verá afastado qualquer responsabilidade oudever de guarda e conservação do(s) item(s) pela Bolsa de Arte.
VII.II. Sendo a hipótese de se proceder ao direito de retirada por meio de envio de empresa contratada pelo arrematante, a responsabilidade será pura e exclusivamente da contratada para realização do frete.
VII.III. Para que a retirada seja exercida por procurador, este último deverá estar ao momento de suaprocedência munido do devido instrumento de procuração.
VII.IV. A Bolsa de Arte não possui qualquer vínculo de responsabilidade com a entrega das obras de arte.
VII.V. Esgotado o prazo de 10 (dez) dias (VII.I) sem a retirada da obra de arte, cessará o seguro, bem comoexigir-se-á taxa de armazenamento.
VIII. EXPORTAÇÃO
VIII.I. Os impostos de exportação e as taxas aduaneiras serão exigidos, respectivamente, no valor de 3% (trêspor cento) e 2% (dois por cento), totalizando 5% do valor arrematado.
VIII.II. Iniciado o processo de exportação, a obra somente será entregue observando-se todos os trâmiteslegais.
VIII.III. Em hipótese de exportação, cobrar-se-á o valor do arremate em dólares, podendo o invoice sofrer reajustes, onde a Bolsa de Arte irá indicar a data do pagamento pelos meios de contato fornecidos pelolicitante.
VIII.IV. Em hipótese de discrepância da taxa cambial, a Bolsa de Arte se reserva ao direito exigir tal diferença,caso necessário.
VIII.V. A quitação do valor será feita em Real-Brasileiro (R$) ao dia do pagamento, valendo, para hipótese defechamento do câmbio, o valor em moeda brasileira.
VIII.VI. As custas de embalagem, transporte e seguro da obra de arte são de responsabilidade do arrematante, não se responsabilizando a Bolsa de Arte por qualquer prejuízo neste sentido.
IX. DEMAIS DISPOSIÇÕES
IX.I. É lícito ao leiloeiro juntar ou retirar qualquer item resumido nos lotes do catálogo, bem como recusar aoferta de licitantes.
IX.II. Os lances realizados na sala ou por ligação telefônica serão gravados, assim como as correspondênciastrocadas via e-mail ou por WhatsApp serão devidamente armazenadas.
IX.III. Possíveis pontos controvertidos ou omissos serão resolvidos segundo o conteúdo do Decreto nº 21.981, de 19 de outubro de 1932 e pelas demais disposições presentes no ordenamento jurídico.
IX.IV. Qualquer litígio oriundo do leilão se submete ao Ordenamento Jurídico Brasileiro, onde o arrematante interessado fica consciente de que esses mesmos litígios serão tratados pela Jurisdição do Foro daComarca da Capital do Estado de São Paulo.
I. AUCTION
I.I. Bolsa de Arte, the organizer of the trading session, with the most due technical expertise incalculation and selection of the art works destined for auction, made the catalog in an accurate anddetailed way, according to the most demanding parameters in the market.
I.II. The works offered at auction are the property of third parties, and sales will take place according to the characteristics of the work of art at the time of the trading session, where it is already assumed thatthe bidder has agreed with the state of the merchandise.
I.III. All the care and caution undertaken in the analysis of the works of art at the auction by Bolsa de Arte does not exempt, nor does it prevent the possible bidder from carrying out a detailed analysis and examination of the works of art destined for the in situ trading session, during the exhibitions that will take place before the session.
I.IV. In order to be able to participate in the auction, the complete filling of the requested data will berequired in a truthful and committed way before the law, leaving as tacit the understanding andacceptance of this document as a whole.
II. RESPONSIBILITY FOR THE AUTHENTICITY OF THE WORKS
II.I. The Bolsa de Arte is responsible for the authenticity of the works made available, based on areport signed by capable and reputable experts.
II.II. The bidder is guaranteed the return of the product, and he may request it in case of proveninauthenticity, within 15 (fifteen) days from the bid.
II.III. The request for return of the final amount described in the above topic must be duly supported by atechnical report, presented and paid by the bidder, within 60 (sixty) days, in order to cancel thetransaction.
II.IV. The report, sufficient to verify possible inauthenticity of the object purchased, must, obligatorily, obey the written form, as well as be signed by an expert recognized in the trade or by a firm whose expertise inthe field is unequivocal.
II.V. The bidder of an unequivocally inauthentic work, proven by a report, will be entitled to the full refund of the bid within 15 (fifteen) business days from the termination of the deal, with theobligation to return the work in question in the same state in which it was at the time of sale.
II.VI. Once the period of 60 (sixty) days mentioned in the above (II.III) has expired, it will no longer be possiblefor the bidder to make supervening claims related to the sale, and for that purpose.
II.VII. Return attempts due allegations of poor conservation of works of art will not be accepted immediately, since the possible bidder may proceed to inspect the works during the exhibitions that take place before thetrading session, according to the content of the clause expressed above.
III. RESPONSIBILITY FOR PICTURES SHOWN
III.I. All pictures of the items made available through the social media of Bolsa de Arte, as well as on its electronic website (https://bolsadearte.com), have the scope to promote fine arts and invite interested parties to the auction only, being, therefore, merely illustrative, not proving to be a sufficient element to fulfill any parameter of technical requirement, in the sense of verifying the state of the object orinfluencing the progress of the bids during the auction.
IV. BIDS
IV.I. The works for the auction have their reserve price duly agreed between the consignor and theconsignee. The auctioneer reserves the right to protect the minimum value agreed.
IV.II. The bids offered have the characteristic of being irreversible and irrevocable in their entirety being, therefore, it is forbidden to exercise repentance, since these bids cannot be voided under anycircumstances.
IV.III. Purchase orders stipulated according to the maximum limit indicated by the interested parties may beaccepted by the auctioneer, in which case an accredited employee will be responsible for bidding up tothe authorized limit.
IV.IV. The bidders will be required, after adjudication, to sign a term of commitment.
IV.V. Once the auction declaration indicating the lot, value and bidder, has issued by the auctioneer, thelegal act is perfectly formed and finished.
IV.VI. Any allegations of loss of opportunity due to instability in the telephone lines, as well as in the online platform of the auction during the trading session, complaining that a certain bid was not computed,cannot be alleged, since Bolsa de Arte is not responsible for maintenance.
IV.VII. It is up to the auctioneer of the trading floor to state the value of the increment for each bid, accordingto his will, experience and progress of the auction.
V. BUYER`S PREMIUM
V.I. The buyer`s premium is a percentage additional charge on the hammer price composed by bothfollowing commissions:
V.II. The auctioneer`s fixed commission will be given, regardless of the value of the bid, that is, in a fixedform, at 5% (five percent) of the final bid value, and must be paid at the time of purchase.
V.III. The commissions to Bolsa de Arte, which is the organizer of the event, must also be paid at the time ofthe purchase, as follows:

VI. PAYMENT
VI.I. At the time of purchase, the bidder must pay the total amount of the lot(s) within 15 calendar days.
VI.II. The commissions, duly described in the previous topic (V.II), are cumulative.
VI.III. Failure to pay the auctioned works will result in cancelation of the sale and the auctioneer and Bolsa deArte may take legal action against the bidder to demand the payment of the amount still standing, ormay also may also as well demand a fine equivalent to 30% (thirty per cent) of the auction price.
VI.IV. The auctioneer, Bolsa de Arte and the consignor also have the possibility to sue the bidder, for the totalamount of the auction and the buyer`s premium.
VI.V. The content of the above provision does not depend on the investigation of losses and damages,monetary correction, legal interest. It is up to the auctioneer to demand the expenses in the executionof the auction.
VI.VI. Both consignor and consignee may also withdraw a credit instrument for cash payment against thebidder, as well as take other enforceable and applicable measures to the detriment of the defaultingbidder.
VI.VII. Payments made by check will be subject to bank inquiry and confirmation, and the auctioneer mayretain the purchased lot until the total amount is received.
VII. WITHDRAWAL
VII.I. The auctioned works must be withdrawn within (10) ten business days after receipt of the total amountby the auctioneer, where after this elapsed period, any responsibility or duty of custody and conservationof the item(s) by Bolsa de Arte will be removed.
VII.II. In the event of proceeding with the right of withdrawal by sending a company contracted by the bidder, the responsibility will be solely and exclusively of the contracted party for carrying out thefreight.
VII.III. In order for the withdrawal to be exercised by an attorney-in-fact, the latter must have written proof of iton withdraw act.
VII.IV. Bolsa de Arte is not responsible for the delivery of works of art.
VII.V. Once the period of 10 (ten) days (VII.I) has expired without the removal of the artwork, the insurance willcease, as well as storage fee will be invoiced in the bidder`s name.
VIII. EXPORT
VIII.I. Export taxes and customs fees will be required, respectively, in the amount of 3% (three percent) and 2%(two percent), totaling 5% of the auctioned amount.
VIII.II. Once the export process has started; the work will only be released in compliance with all legalprocedures.
VIII.III. In the event of export, the final price in dollars will be charged, and the invoice may undergoreadjustments, where Bolsa de Arte will state the date of payment through the contact person(s)provided by the bidder.
VIII.IV. In case of exchange rate discrepancy, Bolsa de Arte reserves the right to demand such difference, ifnecessary.
VIII.V. The amount will be paid in Brazilian Real (R$) on the day of payment, the amount in Brazilian currencyexchange closing.
VIII.VI. The costs of packaging, transport and insurance of the work of art are the responsibility of the bidder,and Bolsa de Arte is not responsible for any damage in this regard.
IX. OTHER PROVISIONS
IX.I. It is lawful for the auctioneer to add or remove any item summarized in the catalog lots, as well as torefuse bidders` offers.
IX.II. Bids made in the room or by phone call will be recorded, as well as correspondence exchanged via emailor WhatsApp will be duly stored.
IX.III. Possible controversial or omitted issues will be resolved according to the content of Brazilian lawDecree No. 21,981, of October 19, 1932 and the other provisions present in the legal system.
IX.IV. Any dispute arising from the auction is subject to the Brazilian Legal System, where the interested bidder is aware that these same disputes will be dealt with by the Jurisdiction of the District Court ofthe Capital of the State of São Paulo.
